1. Overview

This website is operated by TPS Collective Ltd trading as The Prize Society. Throughout these Terms, “The Prize Society”, “we”, “us” and “our” refer to TPS Collective Ltd.

These Terms of Service govern your use of our website and services.

The Prize Society operates a platform through which eligible individuals may participate in competitions through paid entry or our alternative complimentary entry route.

By accessing or using this website, creating an account, purchasing an entry, submitting a complimentary entry or otherwise using our services, you agree to these Terms of Service together with our Competition Terms & Conditions, Privacy Policy and any other policies referred to on this website.

If you do not agree to these Terms, you should not use our website or participate in our competitions.

Where there is any conflict between these Terms of Service and the specific Competition Terms & Conditions applicable to a competition, the Competition Terms & Conditions will take precedence in relation to that competition.


2. Eligibility

Unless otherwise stated in the applicable Competition Terms & Conditions, entrants must:

  • be aged 18 years or over;
  • reside in the United Kingdom;
  • provide accurate and complete information when entering; and
  • comply with the applicable Competition Terms & Conditions.

The Prize Society reserves the right to verify an entrant's eligibility and may request reasonable evidence of identity, age, address or other information where necessary.

Entries that do not meet the applicable eligibility requirements may be rejected or disqualified.


3. Competition Entries

The Prize Society offers both paid competition entry and an alternative complimentary entry route.

Paid entries are submitted through the relevant competition page and are subject to successful payment and satisfaction of the entry requirements displayed for that competition.

The number of paid entries allocated will correspond with the entry quantity selected and successfully purchased.

Complimentary entries may be submitted through our designated Complimentary Entry route without making a purchase and must comply with the requirements displayed on that page and within the applicable Competition Terms & Conditions.

A complimentary entry is not conditional upon making a purchase.

Valid complimentary entries are included in the same relevant competition as paid entries and participate in the same winner-selection process.

Any limits on the number of paid or complimentary entries permitted will be stated in the applicable Competition Terms & Conditions.

We reserve the right to reject, cancel or invalidate entries that are incomplete, ineligible, fraudulent, duplicated contrary to the applicable entry limits, submitted through automated means or otherwise breach these Terms or the applicable Competition Terms & Conditions.


4. Competition Questions

Where a competition requires entrants to answer a question or otherwise satisfy an entry requirement, the applicable requirement will be displayed before entry.

Entrants are responsible for submitting their own answer.

Entries that do not satisfy the applicable competition requirements may not be accepted as valid entries.

The requirements applying to both paid and complimentary entries will be set out on the relevant competition page and/or within the applicable Competition Terms & Conditions.


5. Winner Selection

Valid entries received before the relevant competition closes will be included in the applicable draw.

Winners will be selected at random from the valid entries using the winner-selection system used by The Prize Society.

Paid and valid complimentary entries are included within the same winner-selection process.

The result of the draw will be final, subject to verification of the winner's eligibility and compliance with the applicable Competition Terms & Conditions.

We may request reasonable evidence to verify the identity and eligibility of a selected winner before releasing a prize.

If a selected winner is ineligible, cannot be contacted after reasonable attempts, fails to provide required verification within the timeframe specified by us, or is otherwise disqualified under the applicable Competition Terms & Conditions, we may select an alternative winner in accordance with those terms.


6. Competition Availability and Closing

Each competition will have a stated closing date or other closing condition.

We reserve the right to amend, suspend or cancel a competition where reasonably necessary because of circumstances outside our reasonable control, technical problems, legal or regulatory requirements, suspected fraud or other circumstances that materially affect our ability to administer the competition fairly.

Where a competition is cancelled, we will deal with affected paid entries in accordance with the applicable Competition Terms & Conditions and relevant consumer law.


7. Prizes

The prize available for each competition will be described on the relevant competition page.

Images may be used for illustrative purposes. We will take reasonable care to ensure prize descriptions are accurate.

Values shown are approximate retail values at the time the competition is published and are not guaranteed resale values.

Where a particular item becomes unavailable for reasons outside our reasonable control, we may provide a reasonable substitute of equivalent or greater value where permitted by the applicable Competition Terms & Conditions.

Prizes are non-transferable and no cash alternative will be offered unless expressly stated for the relevant competition or otherwise agreed by The Prize Society.

Prize fulfilment is subject to successful winner verification.


8. Payments

Payments for paid competition entries are processed through third-party payment providers integrated with our ecommerce platform.

The Prize Society does not ordinarily receive or store complete payment card details.

By submitting a payment, you confirm that you are authorised to use the payment method provided and that the information supplied is accurate.

A payment being authorised does not override any eligibility requirements or other conditions applying to the competition.

No payment is required to use the designated complimentary entry route.


9. Refunds and Cancellations

Because paid entries relate to participation in competitions and may be processed shortly after purchase, cancellation and refund rights may differ from those applying to ordinary physical goods.

Nothing in these Terms limits any statutory rights you may have under applicable UK consumer law.

Refunds may be provided where required by law or in circumstances specified in our Returns & Refunds Policy or applicable Competition Terms & Conditions, including where appropriate following:

  • duplicate transactions;
  • technical or payment-processing errors;
  • cancellation of a competition; or
  • other circumstances where a refund is legally required or considered appropriate.

10. Prize Delivery

Unless otherwise stated, reasonable standard delivery costs associated with delivering a physical prize to a verified UK winner will be met by The Prize Society.

Any specific delivery conditions, geographical restrictions or requirements relating to a prize will be stated on the relevant competition page or in the applicable Competition Terms & Conditions.

We are not responsible for delays caused by events outside our reasonable control.


11. Accounts and Website Use

You must not use the website:

  • for any unlawful or fraudulent purpose;
  • to interfere with the operation or security of the website;
  • to attempt to manipulate a competition or winner-selection process;
  • to submit entries through unauthorised automated methods;
  • to impersonate another person; or
  • in any way that breaches these Terms or the applicable Competition Terms & Conditions.

We may restrict or suspend access where we reasonably believe these requirements have been breached.


12. Intellectual Property

Unless otherwise stated, all intellectual property rights in The Prize Society website, branding, graphics, original imagery, text, design and other original content belong to or are licensed to TPS Collective Ltd.

Nothing in these Terms grants you ownership of those rights.

You may not reproduce, distribute, commercially exploit or materially modify our protected content without prior permission, except where permitted by law.

Third-party product names, trademarks and imagery remain the property of their respective owners.


13. Third-Party Services

Our website relies upon third-party services, including ecommerce, payment, communication and competition-administration technologies.

We are not responsible for temporary interruptions caused by third-party services that are outside our reasonable control, although we will take reasonable steps to minimise disruption to our Services.

Links to third-party websites are provided for convenience and do not necessarily constitute endorsement of those websites.


14. Limitation of Liability

Nothing in these Terms excludes or limits liability where doing so would be unlawful, including liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation.

Subject to applicable law, we will not be responsible for losses caused by events outside our reasonable control or losses that were not reasonably foreseeable when you used the Services.

Nothing in these Terms affects your statutory rights as a consumer.


15. Privacy

We process personal information in accordance with our Privacy Policy.

This includes information provided when purchasing paid entries, submitting complimentary entries, contacting us and, where applicable, verifying and fulfilling prizes for winners.


16. Changes to These Terms

We may update these Terms of Service where reasonably necessary to reflect changes to our Services, business practices or legal and regulatory requirements.

The current version will be published on this website together with its latest revision date.

Changes will not unfairly alter the terms of a competition that has already commenced where doing so would materially disadvantage existing entrants, except where necessary for legal, regulatory or other compelling reasons outside our reasonable control.


17. Governing Law

These Terms are governed by the laws of England and Wales.

If you are a consumer, you will retain any mandatory protections and rights available to you under applicable law, including any rights you may have to bring proceedings in the courts applicable to where you live.
